Terms of service

These terms apply to every order placed with Téssera Wines through
tesserawines.com.au, our order forms, or at an event.

Alcohol and age
Under the Liquor Act 1992 (Qld) it is an offence to supply liquor to a person
under 18 years of age, and for a person under 18 years to purchase or receive
liquor. By ordering you confirm that you are at least 18 years old and that
the person receiving the delivery is at least 18 years old. Photo ID may be
requested on delivery. We may refuse or cancel any order, and our couriers
may refuse to hand over a delivery, where we have reason to believe the
recipient is under 18, is intoxicated, or cannot produce ID. Alcohol will not
be left unattended unless you have given an authority to leave, and giving
that authority is your acceptance of the risk of loss once it is left.

Orders
Your order is an offer to buy. A contract is formed only when we accept it,
which we do by dispatching the goods. We may decline an order, or part of it,
including where stock has sold out, where a price or description was listed
in error, or where we cannot deliver lawfully to the address given.

Prices and payment
All prices are in Australian dollars and include GST. Prices and the contents
of packs may change between releases. Payment is taken at the time of order
through Shopify, and your order is not dispatched until payment clears.

Vintages and availability
Our wines are made in small batches. Where a vintage sells out we may supply
the next vintage of the same wine, and we will tell you before we do. Pack
contents may vary with what is available.

Delivery
Dispatch times, carriers and costs are set out in our Shipping policy. Risk
in the goods passes to you on delivery, or when the goods are left under an
authority to leave. Title passes once payment is received in full.

Wine club memberships
Four Vines Club memberships are governed by our Subscription policy, which
covers the membership term, delivery frequency, skipping and pausing,
cancellation and the welcome gift.

Returns, faults and your consumer rights
Our Refund policy sets out how to return an order. Nothing in these terms
excludes, restricts or modifies the consumer guarantees you have under the
Australian Consumer Law, which cannot be contracted out of. If a wine is
faulty, corked, damaged in transit or not as described, contact us and we
will replace it or refund it.

Promotions and discount codes
Discount codes and promotions are for the stated purpose and period, are not
transferable, cannot be exchanged for cash, and may be withdrawn or changed.
Unless we say otherwise, only one code applies per order and codes do not
apply to subscription prices, which already carry a member discount.

Our content
The text, photographs, label artwork and branding on this site belong to
Téssera Wines Pty Ltd and may not be reproduced commercially without our
written permission.

Privacy
We handle personal information as described in our Privacy policy.

Liability
To the extent permitted by law, and subject to the consumer guarantees above,
we are not liable for indirect or consequential loss, and our liability for
any claim is limited to replacing the goods or refunding what you paid for
them.

Governing law
These terms are governed by the law of Queensland, Australia.

Changes
We may update these terms. The version published on this site at the time of
your order is the version that applies.
